Terms & Conditions

All orders booked are based on the distinct understanding that the purchaser agrees to the terms and conditions of sale as stated.

Deposit and Terms (New Accounts) - 25% deposit is required to hold all orders. Balance due 10 days before delivery.

Deposit and Terms (Established Accounts) - 25% deposit, Net 30 days, 1.5% finance charge per month, 18% annual finance charge on all past due accounts.

Discounts - We offer a 2% cash discount on orders over $500 prepaid with cash or check. 2% discount not valid for credit card payment. Discounts only apply to plants, not freight or royalties. Discounts apply only if terms of invoice are met.

Ordering - Total order determines quantity price. Example: 25 each of four varieties gets the 100 rate for all four varieties.

For Orders Under $500.00 - Payment in full due upon order. Minimum shipping and handling $10.00. 1 year rooted cuttings add 20% for shipping and handling. Potted 2 year plants add 30% for shipping and handling, “6, 12 and 24 Plant Specials” see page 14 for freight charges.

For Orders Over $500.00 - Shipping charges will be billed at time of shipment, rather than to attempt to include transportation charges. We feel our policy of charging you only the actual cost means savings
to you.

Transportation - Packing boxes charged at cost. Customer shall designate preference of shipping: UPS, UPS Air, Airfreight or Truck. Customer is responsible for any damage claims caused by shipment. Please advise us of your preference in shipping when you place your order. We must have a shipment routing for truck and air freight shipments.

Transportation Damage - Notify the carrier at once if the box has been turned upside down, broken,crushed, heated, frozen or opened. Mark your receipt for condition and amount of damage. File a claim with the carrier. Ask us for assistance if needed. Let us know promptly. We want to be aware of all damages in transit. Send us snapshots of the damaged material if at all possible. Plants become the property of the purchaser upon delivery to the transportation company and we cannot be responsible for loss,damage or delay in transit. If there is damage or loss, file an immediate claim with the carrier company. If you do not get satisfaction, we will be very happy to assist you.

Shipping and Handling - We recommend not shipping UPS June 1 thru September 15 (will vary depending on weather, please call) because plants are fully leaved out. Customer pick up only during this time. Please call for shipping verification. Please give us 48 hours notice on pick up at Nursery.

Pool Trucks - For large orders over 300 container plants, we will make every attempt to pool orders to your area, reducing the freight cost. Freight COD unless prior arrangements are made. We will be happy to estimate a freight rate.

Limited Warranty - Should any stock prove untrue to name as labeled, it is mutually agreed that our total liability, upon satisfactory proof, shall be limited to replacement or refund not to exceed the original purchase price. All orders are accepted subject to crop failures, damage by natural causes, and we reserve the right to refund all or any part of payment made. We are careful to keep varieties true to name and will replace upon proper proof anything that may be otherwise
or refund original purchase price. We give no warranty expressed or implied as to the growth or productivity and will in no way be responsible for the results secured in transplanting.

Claims - We will correct any errors, but we cannot honor any claims that are not made within 30 days after receipt of the stock. Claims should be made promptly in writing on receipt of stock.
